Terms and Conditions

1. Acceptance of Terms

By accessing and using the services of Marino Home Remodeling ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.

2. Services Description

Marino Home Remodeling provides professional home redesign services including but not limited to:

  • Interior design consultation and planning
  • Space planning and layout design
  • Color and material selection
  • Furniture and accessory selection
  • Project management and coordination
  • Installation and styling services

Specific services will be detailed in individual project agreements.

3. Project Agreement and Scope

Each project begins with a consultation and written agreement that outlines:

  • Scope of work and deliverables
  • Project timeline and milestones
  • Total project cost and payment schedule
  • Client responsibilities and requirements
  • Change order procedures

Any changes to the agreed scope must be documented in writing and may result in additional charges.

4. Payment Terms

Payment Schedule

  • Initial deposit: 50% of total project cost upon signing agreement
  • Progress payments: As outlined in project agreement
  • Final payment: Due upon project completion

Payment Methods

We accept cash, check, credit cards, and bank transfers. A 3% processing fee applies to credit card payments over $1,000.

Late Payments

Late payments may result in project delays and a 1.5% monthly service charge on overdue amounts.

5. Client Responsibilities

Clients are responsible for:

  • Providing accurate information about project requirements
  • Ensuring site access for our team and contractors
  • Obtaining necessary permits and approvals
  • Making timely decisions to avoid project delays
  • Protecting existing furnishings and belongings
  • Maintaining insurance coverage for the property

6. Intellectual Property

All design concepts, plans, and creative work remain the intellectual property of Marino Home Remodeling until full payment is received. Upon full payment, clients receive a license to use the designs for the specific project only.

7. Warranties and Disclaimers

Service Warranty

We warrant that our services will be performed in a professional manner consistent with industry standards. We do not warrant specific outcomes or client satisfaction with aesthetic choices.

Product Warranties

Product warranties are provided by manufacturers. We assist with warranty claims but are not responsible for product defects or failures.

Disclaimers

We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

8. Limitation of Liability

Our liability is limited to the total amount paid for services. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of use, profits, or business opportunities
  • Damages caused by third-party contractors
  • Pre-existing conditions or hidden defects
  • Acts of nature or circumstances beyond our control

9. Cancellation and Refund Policy

Client Cancellation

  • Cancellation within 72 hours of signing: Full refund minus 10% administrative fee
  • Cancellation after work begins: Refund of unused portion minus completed work and expenses
  • Cancellation after 50% completion: No refund available

Company Cancellation

We reserve the right to cancel projects for non-payment, breach of contract, or safety concerns. In such cases, clients will be refunded for work not performed.

10. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, or supplier issues.

11. Dispute Resolution

Any disputes will be resolved through:

  1. Good faith negotiation between parties
  2. Mediation with a mutually agreed mediator
  3. Binding arbitration under California law

Legal proceedings must be filed within one year of the dispute arising.

12. Photography and Marketing

We reserve the right to photograph completed projects for marketing purposes unless specifically prohibited in writing. Client identity will not be disclosed without permission.

13. Governing Law

These terms are governed by California state law. Any legal proceedings will be conducted in California courts.

14. Severability

If any provision of these terms is found unenforceable, the remaining provisions will continue in full force and effect.

15. Modifications

These terms may be updated periodically. Continued use of our services constitutes acceptance of any modifications. Material changes will be communicated to active clients.
